1. Introduction
Welcome to Go Write Me!
These Terms and Conditions ("Terms") govern your access to and use of Go Write Me (the "Website"), including your participation in collaborative stories, your creation of stories and contributions, and your use of any subscription services offered through the Website.
In these Terms, "Go Write Me," "we," "us," and "our" refer to the operator of the Website. "You," "your," "User," and "Subscriber" refer to any person who accesses or uses the Website.
By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Website.
These Terms apply to all users, whether or not they have a paid subscription, except where a provision expressly applies only to Subscribers or Charter Members.
2. Acceptance and Modification of Terms
2.1 Acceptance
Your use of the Website is subject to these Terms and all applicable laws. By accessing or using the Website, you confirm that you have read, understood, and agree to these Terms.
2.2 Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. When appropriate, we may also provide notice through the Website or by email.
Your continued use of the Website after revised Terms become effective constitutes your acceptance of the revised Terms.
If you do not agree with a material change to these Terms, you must stop using the Website and, if applicable, cancel your subscription.
2.3 Electronic Communications
By using the Website, you consent to receiving communications from Go Write Me electronically, including account notices, billing information, security notices, service announcements, and notices concerning changes to these Terms or our policies.
3. Eligibility and User Accounts
3.1 Eligibility
You must be at least 13 years old to use Go Write Me.
If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Website and agree to these Terms.
Go Write Me is not intended for children under 13, and we do not knowingly permit children under 13 to create accounts.
3.2 Account Information
When creating an account, you agree to provide accurate and current information and to keep that information reasonably up to date.
You may not impersonate another person or create an account using another person's identity or information without permission.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
If you believe your account has been accessed without authorization, you should notify Go Write Me as soon as reasonably possible.
3.4 One Account Per User
Unless otherwise permitted by Go Write Me, each person may maintain only one active account. Users may not create additional accounts to evade a suspension, termination, moderation decision, or other restriction.
4. User Content
4.1 Definition of User Content
"User Content" means any story, contribution, text, comment, profile material, image, or other material that you submit, post, upload, create, or otherwise make available through the Website.
4.2 Your Responsibility for Your Content
You are responsible for the User Content you submit and for ensuring that you have the necessary rights and permissions to submit it.
You agree not to submit User Content that violates these Terms, infringes the rights of another person, or violates applicable law.
4.3 Public Nature of User Content
Unless Go Write Me expressly identifies a feature as private, User Content posted on the Website should be considered publicly accessible.
You understand that material posted publicly on the internet may be copied, shared, indexed by search engines, or otherwise viewed or used by people outside Go Write Me.
You are responsible for deciding what information and material you choose to post publicly.
5. Collaborative Stories and Content Ownership
5.1 Original Poster Rights
For purposes of collaborative stories, the person who creates and posts the original story is the "Original Poster" or "OP."
The OP owns the story and, subject to the rights and licenses described in these Terms, owns the contributions submitted by other Users to that story.
The OP may edit, modify, combine, publish, reproduce, distribute, adapt, or otherwise use the story and its contributions in any manner the OP chooses, including outside of Go Write Me.
Go Write Me does not become a co-author or owner of an OP's story merely because the story is hosted on the Website.
5.2 Contributor Assignment
By submitting a contribution to an existing collaborative story, you agree that the contribution becomes the property of the OP.
To the extent permitted by law, you assign to the OP all rights, title, and interest you may have in and to the contribution, including copyright rights.
The assignment includes the right of the OP to edit, modify, reproduce, publish, distribute, adapt, combine, or otherwise use the contribution without further permission from you.
5.3 No Compensation or Attribution
Unless the OP separately agrees otherwise, contributors are not entitled to payment, royalties, ownership interests, or other compensation for contributions submitted to a collaborative story.
Contributors should not expect to receive credit or attribution for their contributions.
By contributing to a collaborative story, you acknowledge that you are voluntarily providing your contribution without an expectation of compensation or attribution.
5.4 No Continuing Rights in a Contribution
Once a contribution has been submitted to a collaborative story, the contributor may not later demand that the OP stop using the contribution solely because the contributor has changed their mind.
This provision does not prevent a User from asserting rights that cannot legally be waived or transferred under applicable law.
5.5 Go Write Me Is Not a Party to User Agreements
Go Write Me provides the platform through which Users create and collaborate on stories.
Go Write Me is not a party to agreements or disputes between Users concerning ownership, authorship, publication, compensation, attribution, or use of User Content.
Any separate agreement between an OP and a contributor is solely between those Users.
6. License to Go Write Me
6.1 License to Operate the Website
When you submit User Content to Go Write Me, you grant Go Write Me a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, format, modify as technically necessary, back up, and otherwise use that User Content as reasonably necessary to operate, maintain, secure, improve, and provide the Website and its features.
This license does not transfer ownership of your User Content to Go Write Me.
6.2 Promotion of the Website
To the extent reasonably necessary to promote Go Write Me and its services, you grant Go Write Me permission to display or reference publicly available User Content, usernames, story titles, or excerpts in connection with the Website.
Go Write Me will not sell your User Content as a standalone product without your permission.
6.3 Survival of License
The licenses granted to Go Write Me under these Terms may continue after removal or deletion of User Content to the extent reasonably necessary for backups, technical systems, legal obligations, dispute resolution, fraud prevention, or enforcement of these Terms.
7. Intellectual Property Rights
7.1 User Rights
By submitting User Content to the Website, you represent that you own the rights necessary to submit that content or have obtained appropriate permission to use it.
You agree not to submit material that infringes another person's copyright, trademark, privacy rights, publicity rights, or other intellectual property or legal rights.
7.2 Original Poster Responsibility
As the OP of a collaborative story, you are responsible for considering whether contributions included in your story are suitable for publication or other use.
Go Write Me does not guarantee that User Content is original, non-infringing, or legally safe to publish.
7.3 Publication and Copyright Risks
If you publish, sell, distribute, or otherwise commercially use a story containing User Content, you are responsible for determining whether you have the rights and permissions necessary to do so.
Go Write Me is not responsible for legal claims resulting from a User's publication or distribution of User Content.
7.4 Go Write Me Intellectual Property
The Website itself, including its software, design, layout, branding, logos, graphics, features, functionality, and other materials provided by Go Write Me, is owned by or licensed to Go Write Me and is protected by applicable intellectual property laws.
These Terms do not grant Users ownership of Go Write Me's intellectual property.
You may not copy, reproduce, modify, distribute, reverse engineer, scrape, or commercially exploit the Website or its underlying functionality except as expressly permitted by Go Write Me or applicable law.
8. Copyright Complaints and DMCA
Go Write Me respects the intellectual property rights of others.
If you believe that material available on Go Write Me infringes your copyright, please follow the procedures described on our DMCA page in the footer of the Website.
Go Write Me may remove or restrict access to allegedly infringing material while a complaint is reviewed.
Go Write Me may terminate accounts of Users who repeatedly infringe the intellectual property rights of others.
Users who knowingly submit false or materially misleading copyright complaints may be subject to liability under applicable law.
9. Prohibited Content and Conduct
You agree not to use Go Write Me to:
violate any applicable law or regulation;
infringe or misappropriate another person's copyright, trademark, privacy, publicity, or other legal rights;
post defamatory, fraudulent, threatening, or intentionally false material about another person;
harass, stalk, threaten, intimidate, or abuse another User;
engage in hate speech or content intended to promote violence or hatred against individuals or groups;
post or distribute child sexual abuse material or other unlawful sexual material;
publish another person's private or identifying information without authorization;
impersonate another person or falsely claim to represent another person or organization;
upload malware, viruses, malicious code, or other harmful material;
attempt to gain unauthorized access to accounts, systems, or Website infrastructure;
interfere with the normal operation of the Website;
use automated systems, bots, scripts, or scraping tools to access or collect Website content without permission;
create accounts to circumvent a suspension, ban, or other restriction;
use the Website for fraudulent, deceptive, or criminal purposes; or
otherwise engage in conduct that Go Write Me reasonably determines is harmful to the Website, its Users, or the community.
Go Write Me reserves the right to remove or restrict any content or account that violates these Terms or that we reasonably believe presents a legal, security, or safety concern.
10. Content Moderation
10.1 Right to Moderate
Go Write Me reserves the right, but not the obligation, to review, moderate, restrict, or remove User Content at our discretion.
We may take action when content violates these Terms, applicable law, the rights of others, or the intended purpose of the Website.
10.2 Moderation Decisions
Go Write Me's moderation decisions are generally within our sole discretion.
Go Write Me is not required to provide an appeal process or to explain every moderation decision.
Nothing in this section prevents a User from exercising rights that cannot legally be waived.
10.3 No Duty to Monitor
Go Write Me does not have a general obligation to monitor User Content or actively search for unlawful or infringing material.
The fact that content remains available does not mean that Go Write Me has reviewed, approved, or endorsed it.
11. Privacy and Data Protection
11.1 Privacy Policy
Go Write Me collects, uses, and processes information in accordance with our Privacy Policy.
By using the Website, you acknowledge that you have had an opportunity to review the Privacy Policy.
11.2 Data Security
Go Write Me takes reasonable measures to protect information maintained through the Website. However, no online service can guarantee absolute security.
You acknowledge that transmission and storage of information online involve inherent risks.
11.3 Public Content
User Content posted publicly on the Website may be viewed, copied, or shared by others. Go Write Me does not guarantee the privacy or confidentiality of publicly posted User Content.
12. Data Backup and Content Permanence
12.1 User Responsibility
You are responsible for maintaining your own copies of stories, contributions, and other User Content that you wish to preserve.
Go Write Me does not guarantee permanent storage of any User Content.
12.2 Technical Problems and Data Loss
Although Go Write Me may maintain backups and reasonable safeguards, data may be lost because of technical failures, human error, security incidents, maintenance, third-party service failures, or other circumstances.
To the fullest extent permitted by law, Go Write Me is not responsible for loss of User Content resulting from such circumstances.
12.3 No Guarantee of Continuous Availability
Go Write Me does not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
13. Publication Risks
13.1 Public Availability
You acknowledge that publishing a story or contribution publicly online may affect your ability to later publish that material through traditional publishers or other services.
13.2 Publisher Policies
Some publishers, literary agents, contests, or other organizations may decline material that has previously been published or made publicly available online.
Go Write Me does not guarantee that content posted on the Website will remain eligible for publication elsewhere.
You are responsible for determining whether posting your material on Go Write Me is compatible with your intended publishing plans.
14. Third-Party Services and Links
Go Write Me may rely on third-party services to provide payment processing, hosting, analytics, email, security, or other Website functions.
Go Write Me is not responsible for the independent actions, policies, availability, or security practices of third-party services.
The Website may also contain links to third-party websites. Go Write Me does not control or endorse third-party websites and is not responsible for their content, policies, or practices.
15. Disclaimer of Warranties
To the fullest extent permitted by law, Go Write Me provides the Website and its services on an "AS IS" and "AS AVAILABLE" basis.
Go Write Me does not guarantee that:
the Website will always be available or uninterrupted;
the Website will be free from errors, bugs, or security vulnerabilities;
User Content will be preserved or remain available;
information available through the Website will always be accurate or complete;
the Website will meet your particular needs or expectations; or
the Website will be free of harmful or infringing User Content.
To the fullest extent permitted by law, Go Write Me disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
16. Misrepresentation and Accuracy of Information
Go Write Me strives to provide accurate information about the Website and its services.
However, features, pricing, availability, descriptions, and other information may change, and we do not guarantee that all information will always be current or error-free.
Go Write Me reserves the right to correct errors and modify Website features or services at any time.
17. Security Breaches
Go Write Me takes reasonable measures to protect its systems and user information.
However, no website, database, or internet transmission can be guaranteed to be completely secure.
You acknowledge the inherent risks of online security and agree to take reasonable precautions when using the Website.
Nothing in these Terms limits any legal rights you may have regarding a security incident.
18. Legal Compliance and Reporting
18.1 Compliance With Law
Go Write Me will comply with applicable laws and lawful governmental requests.
18.2 Law Enforcement Requests
If Go Write Me receives a valid legal request or is otherwise required by law to disclose information, we may provide information as legally required.
Depending on the circumstances and applicable law, this may include account information, User Content, communications, or other information maintained by Go Write Me.
18.3 Immediate Safety or Criminal Concerns
Go Write Me may report suspected criminal activity, threats of violence, exploitation, or other serious unlawful conduct to appropriate authorities when we believe such reporting is appropriate or required by law.
18.4 Reporting Abuse
Users may report harassment, abusive behavior, or other violations of these Terms by contacting [email protected].
Go Write Me will review reports and take whatever action we consider appropriate, including removing content or restricting an account.
Go Write Me is not responsible for disputes or interactions between Users.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Go Write Me and its owners, operators, affiliates, service providers, and representatives from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
your User Content;
your violation of these Terms;
your violation of applicable law;
your infringement or alleged infringement of another person's rights; or
your misuse of the Website.
This provision does not require you to indemnify Go Write Me for liability caused by Go Write Me's own intentional misconduct or to the extent such indemnification is prohibited by applicable law.
20. Termination and Suspension
20.1 Termination by Go Write Me
Go Write Me may suspend, restrict, or terminate your account or access to the Website if we believe you have violated these Terms, engaged in harmful conduct, created legal or security risks, or otherwise misused the Website.
We may also discontinue the Website or particular features at any time.
20.2 Termination by User
You may stop using the Website at any time.
If you have a paid subscription, cancellation is governed by Section 21.
20.3 Effect of Termination
Termination of an account does not automatically transfer ownership of stories or contributions to Go Write Me.
Previously published User Content may remain on the Website, including where necessary to preserve collaborative stories, honor ownership rights belonging to an OP, comply with legal obligations, resolve disputes, prevent abuse, or maintain technical records.
Go Write Me may remove or retain User Content at its discretion, subject to applicable law and the rights described in these Terms.
20.4 Survival
Provisions concerning ownership, licenses, intellectual property, disclaimers, indemnification, limitations of liability, dispute resolution, and any other provisions that by their nature should survive termination will continue to apply after termination.
21. Subscription Terms
21.1 Subscription Fee
Certain features of Go Write Me require a paid monthly subscription. The current subscription price will be displayed at the time of purchase.
A subscription may provide access to features such as your dashboard, creating stories, creating contributions, and other features designated by Go Write Me as subscription benefits.
21.2 Automatic Renewal
Your subscription begins on the date you subscribe and automatically renews monthly unless canceled.
You authorize Go Write Me or its payment processor to charge your selected payment method the applicable subscription fee at the beginning of each renewal period.
The price and renewal terms will be disclosed at the time of purchase.
21.3 Payment Method
You must provide a valid payment method when subscribing.
You authorize the applicable payment processor to charge your payment method for the subscription and any applicable taxes or other amounts disclosed at checkout.
21.4 Cancellation
You may cancel your subscription through your user settings by unsubscribing or by contacting the Website administrators through the contact link in the footer menu.
Cancellation prevents future renewal.
Unless otherwise stated at the time of purchase or required by law, you will retain access to paid subscription benefits through the end of the current billing period.
21.5 Refunds
Subscription payments are generally non-refundable.
However, this does not limit any refund or cancellation rights required by applicable law, nor does it prevent Go Write Me from issuing a refund or credit at its discretion.
21.6 Failed Payments
If a subscription payment fails, Go Write Me may suspend or restrict access to paid features until payment is successfully completed.
21.7 Changes to Subscription Fees
Go Write Me may change subscription fees from time to time.
If the price of an existing subscription is increased, we will provide notice as required by applicable law and will provide an opportunity to cancel before the increased price takes effect where required.
21.8 Subscription Termination
Go Write Me may suspend or terminate a subscription if you violate these Terms, misuse the Website, or if Go Write Me discontinues the applicable subscription service.
If Go Write Me discontinues a paid service, any refund required by applicable law will be provided.
22. Charter Members
22.1 Eligibility
A limited number of early Users, not exceeding 50, may be designated as Charter Members. Go Write Me retains the right to determine when Charter Member eligibility ends, based on site activity and community development goals.
Charter Members are the first qualifying participants who register and actively contribute to the Website by either:
posting a new story; or
contributing to an existing story.
22.2 Activity Requirement
To qualify for Charter Member status, a User must complete at least one qualifying story creation or contribution within 30 days after registration.
Users who do not meet this requirement may have their accounts deactivated, may lose Charter Member eligibility, or may be reclassified as regular Users.
22.3 Charter Member Benefit
Qualifying Charter Members are exempt from Go Write Me subscription fees for the lifetime of the Website, provided that the Website remains operational and the Charter Member account remains in good standing.
Charter Member status does not guarantee continued operation of the Website or any particular feature.
22.4 Number of Charter Members
No more than 50 Users may hold Charter Member status under this program.
Once the maximum number of qualifying Charter Members has been reached, no additional Users will receive Charter Member status.
22.5 Charter Member Status
Charter Member status is personal to the qualifying User and may not be sold, transferred, assigned, or exchanged.
Go Write Me may revoke Charter Member status if it was obtained through fraud, abuse, misrepresentation, or violation of these Terms.
22.6 Discontinuation of Charter Member Program
Go Write Me may stop accepting new Charter Members once the program's maximum has been reached or when Go Write Me determines that the program has ended.
Ending the Charter Member program does not, by itself, terminate the benefits of Users who have already validly obtained Charter Member status.
23. Limitation of Liability
23.1 Exclusion of Certain Damages
To the fullest extent permitted by law, Go Write Me and its owners, operators, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or use, arising out of or related to your use of or inability to use the Website.
23.2 Liability Cap
To the fullest extent permitted by law, Go Write Me's total liability to you for all claims arising out of or relating to the Website or these Terms will not exceed the amount you paid to Go Write Me during the twelve months immediately preceding the event giving rise to the claim.
23.3 Exceptions
Nothing in these Terms limits liability to the extent that applicable law prohibits such limitation.
24. Governing Law
These Terms are governed by applicable law, without regard to conflict-of-law principles. Nothing in these Terms is intended to deprive you of any mandatory rights or protections provided by the laws that apply to you.
25. Dispute Resolution and Arbitration
25.1 Informal Resolution
Before beginning formal legal proceedings, you agree to contact Go Write Me at [email protected] and give us a reasonable opportunity to resolve the dispute informally.
25.2 Binding Arbitration
Except where prohibited by law or otherwise stated below, disputes arising out of or relating to these Terms or your use of Go Write Me will be resolved through binding individual arbitration rather than in court.
The arbitration will be conducted by a mutually agreed-upon arbitrator under the applicable rules of a recognized arbitration provider.
25.3 Individual Claims Only
To the extent permitted by law, disputes must be brought on an individual basis. You and Go Write Me agree not to participate in a class action, class-wide arbitration, collective action, or representative action against one another.
25.4 Small Claims
Nothing in this section prevents either party from bringing an eligible individual claim in small claims court where permitted by applicable law.
25.5 Injunctive Relief
Nothing in these Terms prevents Go Write Me from seeking temporary or preliminary injunctive relief from a court when reasonably necessary to protect the Website, its systems, intellectual property, confidential information, or Users.
25.6 Arbitration Law
The Federal Arbitration Act, where applicable, governs the interpretation and enforcement of the arbitration provisions of these Terms.
If any portion of this arbitration section is found unenforceable, the remaining portions will remain in effect to the extent permitted by law.
26. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
27. No Waiver
If Go Write Me does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.
28. Assignment
You may not assign or transfer your rights or obligations under these Terms without Go Write Me's prior written consent.
Go Write Me may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, transfer of the Website, or change in ownership or control.
29. Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly incorporated into these Terms, constitute the entire agreement between you and Go Write Me concerning your use of the Website.
They supersede prior agreements, representations, or understandings concerning your use of the Website, except for any separate written agreement expressly entered into by Go Write Me.
30. No Agency or Partnership
These Terms do not create an employment relationship, partnership, joint venture, agency relationship, or other business relationship between you and Go Write Me.
Users participate on Go Write Me as independent users of the Website.
31. Changes to the Website
Go Write Me may add, remove, modify, suspend, or discontinue features, services, or portions of the Website at any time.
We may do so temporarily or permanently and may provide notice when appropriate.
Go Write Me does not guarantee that any particular feature will remain available indefinitely.
